These Terms of Service ("Terms") govern your use of the MindBodyHuman mobile application and related services (the "App") operated by MindBodyHuman Pty Ltd ("MindBodyHuman", "we", "us", "our"). By accessing or using the App, you agree to be bound by these Terms.

1. About the App

MindBodyHuman is a wellness and lifestyle application that provides personalised habit plans, health insights, and educational content to support individuals in managing their health through lifestyle changes. The App is designed to complement, not replace, professional medical care.

2. Not Medical Advice

The App does not provide medical advice, diagnosis, or treatment. All content, recommendations, and insights provided through the App are for general wellness and educational purposes only. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

You should always consult a qualified healthcare professional before making changes to your health routine, particularly if you have a diagnosed medical condition, are pregnant or breastfeeding, are taking medication, or are experiencing new or worsening symptoms.

If you are experiencing a medical emergency, contact your local emergency services immediately. Do not rely on the App for emergency medical situations.

3. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to update your information as needed. You must notify us immediately of any unauthorised use of your account.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse-engineer, decompile, or disassemble the App
• Copy, modify, or distribute App content without our written permission
• Use the App to collect information about other users
• Interfere with or disrupt the App's functionality or infrastructure
• Misrepresent your identity or impersonate another person

6. Health Data and Privacy

Your use of the App involves the collection and processing of health-related information. Please refer to our Privacy Policy for details on how we collect, use, store, and protect your personal and health information.

7. Apple HealthKit Integration

The App may integrate with Apple HealthKit to read health data such as sleep and activity information. This integration is optional and requires your explicit consent. Data obtained through HealthKit is used solely to personalise your experience within the App and is handled in accordance with Apple's HealthKit guidelines and our Privacy Policy.

8. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, design, habit content, health insights, algorithms, and software — are owned by MindBodyHuman Pty Ltd and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our express written consent.

9. Pilot Program Terms

If you are participating in a MindBodyHuman pilot program, the following additional terms apply:

• Participation is voluntary and you may withdraw at any time
• You agree to complete pre- and post-program questionnaires as part of the pilot evaluation
• Anonymised and aggregated data from the pilot may be used for research, reporting, and product improvement purposes
• The App may be updated or modified during the pilot period based on participant feedback
• The pilot program is provided at no cost and does not guarantee ongoing access to the App after the pilot period

10. Disclaimers

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's accuracy, reliability, completeness, or suitability for any particular purpose. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.

Health outcomes vary between individuals. We do not guarantee any specific health outcomes or symptom improvements from using the App. Your results may vary depending on your individual circumstances, adherence to the habit plan, and other factors outside our control.

11. Limitation of Liability

To the maximum extent permitted by law, MindBodyHuman Pty Ltd and its directors, employees, and advisors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages for loss of health, data, profits, or goodwill.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless MindBodyHuman Pty Ltd and its directors, employees, and advisors from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

14. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App and request deletion of your account at any time by contacting us.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
